Terms of Service

These Terms of Service ("Terms") govern your use of the Custode bracelet, application, and website (the "Service"). By purchasing a Custode bracelet or creating an account, you agree to these Terms.

1. The Service

Custode provides a GPS tracking bracelet and companion app that allows parents and guardians to monitor the real-time location of the bracelet wearer. The Service requires an active cellular connection and a compatible SIM card.

2. Eligibility

You must be at least 18 years old and a legal parent or guardian of the bracelet wearer to use the Service. By creating an account, you confirm that you have legal authority to monitor the wearer's location.

3. Account Responsibility

You are responsible for maintaining the security of your account credentials. You are responsible for all activity under your account. Notify us immediately if you suspect unauthorised access.

4. Purchases and Payments

• All prices are listed in Euros (EUR) and include applicable VAT
• Payment is processed securely through Stripe
• Orders are confirmed via email upon successful payment
• Shipping times are estimates and may vary

5. Returns and Refunds

You may return an unused Custode bracelet within 30 days of delivery for a full refund. The bracelet must be in its original packaging and undamaged. Contact support@mycustode.com to initiate a return. Return shipping costs are the buyer's responsibility unless the product is defective.

6. Warranty

Each Custode bracelet comes with a 2-year limited warranty covering manufacturing defects. The warranty does not cover damage from misuse, water submersion beyond rated IP levels, or unauthorised modification.

7. Limitations

The Service depends on GPS satellite availability and cellular network coverage. We do not guarantee uninterrupted or error-free location tracking. Custode is not a substitute for direct supervision of children.

8. Limitation of Liability

To the maximum extent permitted by law, Custode shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Service.

9. Modifications

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of Italy. Any disputes shall be resolved in the courts of Naples, Italy.
